Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Social Launchpad (“Service”), operated by Headspace Software LLC (“Company,” “we,” “us,” or “our”), a Wyoming limited liability company. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Social Launchpad is an AI-powered content generation platform that helps users create social media posts, replies, and blog content. The Service uses third-party AI providers (including Anthropic Claude, OpenAI, and Google Gemini) to generate content based on user-provided project context.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate and complete information when creating an account.
• You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

4.1

Social Launchpad offers paid subscription plans. Prices, features, and usage limits are described on our pricing page and may change with notice.

4.2

Subscriptions are billed monthly or annually via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.3

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No pro-rated refunds are provided for partial months.

4.4

We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Lifetime Deals

5.1

Lifetime Deal (“LTD”) purchases grant perpetual access to the features available at the time of purchase, as described on the purchase page.

5.2

LTD purchases include a 14-day money-back guarantee from the date of purchase. After 14 days, LTD purchases are non-refundable.

5.3

“Lifetime” refers to the lifetime of the Service. If the Service is permanently discontinued, LTD holders will receive at least 90 days' notice.

6. Bring Your Own Key (BYOK)

6.1

Certain plans allow you to provide your own AI provider API keys. When using BYOK, you are subject to the terms and pricing of the respective AI provider (Anthropic, OpenAI, Google).

6.2

Your API keys are encrypted at rest using AES-256-GCM and are never displayed in full after initial entry.

6.3

We are not responsible for charges incurred on your AI provider account through your use of the Service.

7. Content Ownership

7.1

You retain ownership of all content you input into the Service (project descriptions, knowledge bases, uploaded documents, post metrics).

7.2

AI-generated content created through the Service is owned by you. We claim no ownership over content generated for your use.

7.3

You grant us a limited license to use your input content solely for the purpose of providing the Service (generating content, analyzing performance, improving AI recommendations).

7.4

We do not use your content to train AI models. Your project data is not shared with other users or third parties except as necessary to operate the Service (e.g., sending prompts to AI providers for generation).

8. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, available at social-launchpad.app/acceptable-use. Violations may result in account suspension or termination.

9. AI-Generated Content Disclaimer

9.1

Content generated by the Service is produced by AI and may contain inaccuracies, errors, or inappropriate material despite our content policy safeguards.

9.2

You are solely responsible for reviewing, editing, and publishing AI-generated content. We are not responsible for any consequences of publishing AI-generated content.

9.3

AI-generated content should not be relied upon as factual, legal, medical, or financial advice.

10. Service Availability

10.1

We strive to maintain high availability but do not guarantee uninterrupted or error-free service.

10.2

We may modify, suspend, or discontinue any part of the Service with reasonable notice.

10.3

Scheduled maintenance will be communicated in advance when possible.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEADSPACE SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Headspace Software LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or content you publish using the Service.

13. Termination

13.1

You may terminate your account at any time by canceling your subscription and contacting us to delete your account.

13.2

We may terminate or suspend your account for violation of these Terms or the Acceptable Use Policy, with or without notice depending on severity.

13.3

Upon termination, your right to access the Service ceases. Your data will be retained for 30 days after termination, after which it may be permanently deleted.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
